Welcome to SHB Developerss. By proceeding with any pre-booking or booking process on our website or through our authorized sales representatives, you acknowledge and agree to the following Terms & Conditions, including our Cancellation and Refund Policy.

Please read this document carefully before making any payment or commitment.

1. Pre-Booking / Booking Process

As part of the pre-booking or booking process, an applicant (“Customer” or “Applicant”) is required to:

• Complete and submit the prescribed booking form, and
• Pay the agreed Pre-Booking / Booking Token Amount as communicated by SHB Developerss.

The submission of this form and payment of the token amount signifies the Applicant’s intent to proceed with the purchase of a specified property unit (Apartment/Plot/Villa/Row House/Row Villa) under a project developed by SHB Developerss.

2. Non-Refundable Conditions

The entire Pre-Booking / Booking Token becomes non-refundable under any of the following circumstances:

• Upon conversion of pre-booking into a confirmed booking; or
• Upon selection of a specific Unit / Apartment / Plot / Villa / Row Villa / Row House; or
• If the Applicant fails to submit a valid withdrawal request within the stipulated project-specific timeline.

Once any of the above events occur, the pre-booking/booking amount shall be forfeited, and the pre-booking or booking shall stand cancelled automatically.

3. Withdrawal & Refund Requests

In case the Applicant wishes to withdraw from a pre-booking or booking, a formal withdrawal request must be sent via email to the respective SHB Developerss project email ID: info@shbdeveloperss.com

Important Notes:

• Withdrawal requests through any channel other than email (such as calls, WhatsApp, or physical letters) will not be considered valid.
• The permissible withdrawal period may vary from project to project. Requests received beyond the stipulated period will not be accepted, resulting in forfeiture of the pre-booking/booking amount.

4. Refund Timelines

For valid withdrawals (where applicable), the refund amount—if any—will be processed and credited to the original source account of the payee within 60 working days from the date of receipt of the withdrawal request email.

SHB Developerss shall not be responsible for delays caused by banking processes or third-party payment gateways.

5. Cancellation After Unit Selection

Once the Applicant has selected a specific unit and completed the booking form, any subsequent cancellation shall lead to forfeiture of the entire amount paid as of the cancellation date (up to 9.9% of the total consideration value).

No further refund or claim shall be entertained under any circumstances.

6. Rights & Ownership

Any rights or interests in the selected Apartment / Plot / Villa / Row Villa / Row House shall accrue to the Applicant only upon:

• Full payment as per the agreed payment schedule, and
• Execution and registration of the Agreement of Sale / Sale Deed.

Until such time, SHB Developerss retains all rights over the said unit.

7. Company Rights

• SHB Developerss reserves the right to encash or deposit the refundable booking amount without prior notice.
• Eligibility for any promotional offer, price benefit, or scheme is strictly subject to realization of the booking amount.

8. Cancellation Charges

In the event of cancellation, termination, or withdrawal of an application for any reason whatsoever, the following cancellation policy shall apply:

1. Post Unit Selection but Before Execution of Agreement of Sale:
   Entire amount paid as on the cancellation date will be forfeited.
2. Post Execution of Agreement of Sale:
   Terms and conditions outlined in the signed Agreement of Sale shall prevail and will be final and binding.

The Cancellation Charges constitute a genuine pre-estimate of damages incurred by the Company, including loss of opportunity and administrative costs. These will be treated as liquidated damages and deducted from the Applicant’s payments.

Upon acceptance of a cancellation request, SHB Developerss reserves the right to immediately re-allot or re-sell the said property unit to any other party, on such terms as the Company deems fit.

9. Limitation of Liability

SHB Developerss shall not be held liable for:

• Any loss or damage arising out of Applicant’s failure to comply with payment schedules or withdrawal timelines;
• Any delay in refund processing attributable to banking or third-party intermediaries; or
• Any misinterpretation of these terms.

10. General Terms

• All disputes are subject to the jurisdiction of competent courts at [City Name of Head Office, e.g., Bengaluru] only.
• SHB Developerss reserves the right to modify or amend these terms without prior notice.
• Errors & Omissions Excepted (E&OE).
